1. Acceptance of Terms
By accessing or using Flex Storage Park's services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our Services.
These Terms apply to all users, including customers, visitors, and any other users of the platform.
2. Definitions
- "Facility" means the physical self-storage location operated by Flex Storage Park
- "Unit" means the individual storage space rented by the Customer
- "Customer" or "Tenant" means the person or entity renting a storage unit
- "Property" means items stored in the Unit by the Customer
- "Rental Agreement" means the contract between Customer and Flex Storage Park
3. Eligibility
You must be at least 18 years of age and legally capable of entering into binding contracts to use our Services. By registering an account, you represent and warrant that:
- You are at least 18 years old
- All information you provide is accurate and complete
- You have the legal capacity to enter into this agreement
- You will comply with all applicable laws and regulations
4. Account Registration and Security
4.1 Account Creation
To rent a storage unit, you must create an account. You agree to:
- Provide accurate, current, and complete information
- Maintain and promptly update your account information
- Maintain the security of your password and access credentials
- Notify us immediately of any unauthorized access
4.2 Account Responsibility
You are responsible for all activities that occur under your account. You agree not to share your account credentials or allow others to access your account.
4.3 Identity Verification
We may require government-issued identification for account verification and unit rental. This is standard industry practice for security purposes.
5. Storage Unit Rental
5.1 Rental Agreement
Rental of a storage unit constitutes a license to use the space, not a lease or conveyance of any property interest. We retain full ownership and control of the Facility and Units.
5.2 Unit Availability
Unit sizes and availability are subject to change. We reserve the right to substitute comparable units if your originally selected unit becomes unavailable.
5.3 Access Hours
Facility access hours are posted on our website and at the Facility entrance. We reserve the right to modify access hours with reasonable notice.
5.4 Use of Unit
You agree to use your Unit only for lawful storage purposes. You may NOT store:
- Hazardous, toxic, flammable, or explosive materials
- Perishable goods, food items, or anything that may attract pests
- Live animals or plants
- Illegal substances or contraband
- Stolen property or property subject to liens
- Firearms, ammunition, or weapons (unless permitted by law and disclosed)
- Items that produce odors, fumes, or excessive noise
- Items that pose health or safety risks
5.5 No Habitation
Units may not be used as a residence, place of business, or for any purpose other than storage. No one may sleep, cook, or live in any Unit.
6. Payment Terms
6.1 Rental Fees
Rental fees are due in advance on the date specified in your Rental Agreement. Payment is typically due monthly on the anniversary of your move-in date.
6.2 Payment Methods
We accept credit cards, debit cards, and other payment methods as indicated during checkout. You authorize us to charge your payment method for recurring monthly fees.
6.3 Late Payments
If payment is not received by the due date, your account will be considered delinquent and subject to:
- Late fees as specified in your Rental Agreement
- Suspension of access to your Unit
- Collection proceedings
- Lien placement and potential auction of stored Property (per applicable lien laws)
6.4 Rate Changes
We reserve the right to change rental rates with 30 days' advance written notice. Continued use of the Unit after the notice period constitutes acceptance of the new rate.
6.5 Additional Fees
You may be charged additional fees for:
- Lock cutting (if access is required and you are unavailable)
- Returned payments or failed transactions
- Administrative fees for account maintenance
- Damage to the Unit or Facility
7. Lien Rights and Remedies
In accordance with applicable self-storage lien laws, we have the right to place a lien on your stored Property for unpaid rent and fees. If payment remains delinquent:
- We may deny access to your Unit
- We may place an overlocking device on your Unit
- After proper notice, we may sell your Property at public auction to satisfy the debt
- You will remain liable for any deficiency after the auction
All lien enforcement actions will comply with applicable state and federal laws.
8. Security and Surveillance
8.1 Security Measures
We provide security measures including access control systems, surveillance cameras, and facility monitoring. However, we do NOT guarantee the security of your Property.
8.2 Locks and Access
You are responsible for providing and maintaining a lock on your Unit. We recommend using a high-security lock. You must provide us with lock access or an emergency key for authorized entry situations.
8.3 Authorized Entry
We reserve the right to enter your Unit without notice:
- In emergency situations (fire, flood, suspected hazardous materials)
- To inspect for prohibited items or lease violations
- When required by law enforcement with proper legal authority
- For facility maintenance or repairs
- To enforce lien rights for delinquent accounts
9. Liability and Insurance
9.1 Limitation of Liability
WE ARE NOT LIABLE FOR ANY LOSS, DAMAGE, OR THEFT OF YOUR PROPERTY, regardless of cause, including but not limited to:
- Fire, flood, water damage, or natural disasters
- Theft, vandalism, or burglary
- Pest infestation (rodents, insects, etc.)
- Temperature or humidity fluctuations
- Power outages or equipment failures
- Acts of third parties
9.2 Insurance Requirement
YOU ARE STRONGLY ENCOURAGED TO OBTAIN INSURANCE for your stored Property. We do not provide insurance coverage. You are solely responsible for insuring your Property at replacement value.
9.3 Your Liability
You are liable for damage to the Unit, Facility, or third-party property caused by you, your Property, or your guests. You agree to indemnify and hold us harmless from any claims arising from your use of the Services.
10. Termination
10.1 By Customer
You may terminate your rental at any time by providing written notice, removing all Property, and paying all outstanding fees. Rental fees are not prorated for partial months.
10.2 By Flex Storage Park
We may terminate your rental and deny access for:
- Non-payment of rent or fees
- Violation of these Terms
- Storage of prohibited items
- Illegal activity or misuse of the Unit
- Abandonment of the Unit
10.3 Move-Out Requirements
Upon termination, you must:
- Remove all Property from the Unit
- Clean the Unit and remove all debris
- Remove your lock
- Return all access devices (keys, fobs, etc.)
- Pay all outstanding balances
11. Prohibited Activities
You may not:
- Transfer or sublease your Unit to another party
- Operate a business from the Facility
- Disturb other tenants or interfere with Facility operations
- Tamper with security systems, locks, or surveillance cameras
- Bring unauthorized persons onto the Facility premises
- Loiter on the premises beyond reasonable time for accessing your Unit
- Park vehicles or trailers on the premises (unless specifically allowed)
12. Intellectual Property
All content on our platform, including text, graphics, logos, and software, is owned by Flex Storage Park and protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our written permission.
13. Dispute Resolution
13.1 Informal Resolution
We encourage you to contact us first to resolve any disputes informally. Most disputes can be resolved quickly through communication.
13.2 Arbitration
Any disputes that cannot be resolved informally will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You waive your right to a jury trial.
13.3 Class Action Waiver
You agree to resolve disputes on an individual basis only. You waive any right to participate in class action lawsuits or class-wide arbitrations.
14. General Provisions
14.1 Governing Law
These Terms are governed by the laws of Puerto Rico and the United States, without regard to conflict of law principles.
14.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.
14.3 Entire Agreement
These Terms, along with your Rental Agreement and our Privacy Policy, constitute the entire agreement between you and Flex Storage Park.
14.4 Amendments
We reserve the right to modify these Terms at any time. We will notify you of significant changes. Continued use after changes constitutes acceptance.
14.5 Force Majeure
We are not liable for delays or failures in performance due to causes beyond our reasonable control, including natural disasters, war, terrorism, or government actions.
